These Terms of Service (“Terms”) govern your access to and use of the TheMazicc website, online store, products, content, communications, tools, and related services.

Throughout these Terms, “TheMazicc,” “we,” “us,” and “our” refer to the operator of the TheMazicc online store. “Services” refers to our website, online store, products, communications, and related services.

Our website is hosted through Hostinger, which provides website-hosting infrastructure used to make the Site available. Additional e-commerce, payment, fulfilment, communication, analytics, and shipping functionality may be provided by third-party service providers.

By visiting the Site, placing an order, creating an account, submitting content, subscribing to communications, or otherwise using the Services, you agree to these Terms and the policies incorporated into them by reference.

If you do not agree to these Terms, you must not use the Services.

1. Eligibility and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your country, state, province, or territory of residence.

If you have not reached the age of majority, you may use the Services only with the permission and involvement of a parent or legal guardian where permitted by law.

You agree to provide accurate, current, and complete information when:

• Creating an account;
• Placing an order;
• Submitting payment information;
• Providing a shipping or billing address;
• Requesting a cancellation, refund, return, exchange, or replacement; or
• Contacting Customer Support.

You are responsible for protecting your account credentials and for activity conducted through your account.

Notify TheMazicc promptly if you believe an account, order, or payment method has been used without authorization.

We may suspend or restrict an account where we reasonably suspect fraud, payment abuse, unlawful conduct, security risks, or a material violation of these Terms.

2. Products and Made-to-Order Production

Many TheMazicc products are printed, personalised, assembled, or manufactured after an order is placed.

Production may include:

• Artwork preparation;
• Printing or manufacturing;
• Personalisation;
• Quality inspection;
• Packing; and
• Transfer to a shipping carrier.

Orders may be produced or fulfilled by third-party manufacturers, printers, warehouses, and fulfilment facilities.

Products from the same order may occasionally be produced at different facilities and arrive in separate parcels.

Because products are often made specifically for an individual order, cancellations, modifications, returns, refunds, exchanges, and replacements are subject to the deadlines and procedures in our published policies.

3. Product Information and POD Tolerances

We make reasonable efforts to display product descriptions, measurements, photographs, mockups, colours, designs, artwork, and other product information accurately.

Actual product appearance may vary because of:

• Screen and display settings;
• Lighting conditions;
• Fabric, material, and texture;
• Ink and printing methods;
• Manufacturing processes; and
• Normal differences between production batches.

A minor colour difference between a digital image and the physical product is not necessarily a defect.

For print-on-demand products, a design-placement difference of approximately 1–2 inches may fall within normal production tolerance where the design remains correctly oriented and the product remains usable.

The following remain eligible for review:

• A materially incorrect colour;
• A substantially misplaced design;
• An incorrectly oriented design;
• A significant printing defect;
• A missing design element;
• An incorrect product variant; or
• Another material difference from the confirmed order.

4. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated order-confirmation message acknowledges receipt of the order but does not necessarily mean that the order has been finally accepted.

We may review, reject, limit, or cancel an order for reasons including:

• Payment authorization failure;
• Suspected fraud or unauthorized activity;
• Incorrect pricing or product information;
• Technical or website errors;
• Production or availability limitations;
• Shipping or destination restrictions;
• Sanctions, legal, or regulatory requirements;
• Promotion, refund, replacement, or discount abuse;
• Unusually large, repetitive, or reseller-style orders; or
• A violation of these Terms or another TheMazicc policy.

We may limit quantities per customer, account, household, payment method, billing address, shipping address, or order.

If we cancel an order after payment has been collected, we will process a refund for the applicable amount unless the transaction has already been reversed, disputed, or charged back.

5. Prices, Currency, Taxes, and Payments

Prices and transactions are generally displayed and processed in United States dollars (USD), unless checkout expressly displays another supported currency.

The final order total may include:

• Product charges;
• Shipping charges;
• Optional shipping-protection charges;
• Taxes collected at checkout where applicable; and
• Other charges disclosed before the order is submitted.

International customers may separately owe import duties, value-added taxes, customs-clearance charges, brokerage fees, storage fees, currency-conversion fees, or local carrier charges.

Payment must be successfully authorized before production or fulfilment begins.

Available payment methods are those displayed at checkout.

Payment providers may independently apply authentication, security, fraud-screening, currency-conversion, or transaction requirements.

We do not directly store complete payment-card numbers or card security codes on our own servers.

6. Cancellations and Modifications

Cancellation and modification eligibility may depend on how far the order has progressed through production and fulfilment.

Submit cancellation or modification requests as soon as possible by emailing support@themazicc.com.

Include:

• Your order number;
• Your full name;
• The email address used for the order; and
• The exact change or cancellation requested.

We will make a reasonable effort to apply an eligible request, but changes cannot be guaranteed after production, personalisation, fulfilment, shipping preparation, or carrier processing has begun.

Correctly made personalised or custom products may not qualify for cancellation or change-of-mind refunds after production has started, except where required by applicable law.

7. Shipping and Delivery

Total delivery time consists of processing time plus shipping transit time.

Processing times, shipping charges, available carriers, delivery estimates, tracking procedures, address restrictions, customs responsibilities, remote-area charges, and delivery-issue procedures are explained in our Shipping Policy.

Delivery dates are estimates unless TheMazicc expressly confirms a guaranteed delivery deadline in writing.

Delivery may be affected by:

• Production demand;
• Carrier congestion or disruption;
• Customs processing;
• Severe weather;
• Public holidays;
• Incorrect delivery information;
• Remote-area conditions;
• Security inspections;
• Labour disruption;
• Regional emergencies; or
• Other circumstances outside our reasonable control.

A carrier status of “Delivered” does not automatically qualify an order for a refund or replacement. Delivered-but-not-received claims may be subject to carrier investigation.

8. Returns, Refunds, Exchanges, and Replacements

Returns, refunds, exchanges, replacements, wrong-size requests, defects, damage, lost parcels, and delivery issues are governed by:

• Exchange & Replacement Policy; and
• Shipping Policy.

Claims relating to a delivered product should generally be submitted within 30 days from delivery.

A physical return must not be sent unless TheMazicc provides written Return Authorization and confirms the applicable return destination.

TheMazicc does not publish a universal return address because the correct destination may depend on the product, production facility, customer location, and reason for return.

A customer may receive one primary remedy for an approved issue but may not receive multiple primary remedies for the same product problem.

9. SMS and Email Marketing

SMS Marketing

Where SMS marketing is offered, you may opt in by providing a mobile telephone number and completing the applicable consent process.

Messages may include:

• Promotional offers;
• Abandoned-cart or abandoned-checkout reminders;
• Product announcements;
• Order updates;
• Delivery notifications; and
• Customer-service communications.

Consent to receive promotional SMS messages is not a condition of purchase.

Message frequency may vary. Message and data rates may apply.

You may opt out of promotional SMS messages by replying STOP. Where supported, reply HELP for assistance.

Email Marketing

If you subscribe to promotional email, we may send newsletters, promotions, product announcements, surveys, and abandoned-cart reminders.

You may unsubscribe using the link included in a promotional email or by contacting support@themazicc.com.

You may continue to receive necessary transactional communications relating to orders, payments, shipping, security, refunds, returns, replacements, support requests, or legal notices.

10. Intellectual Property

Website content—including text, photographs, artwork, graphics, designs, logos, videos, icons, product descriptions, page layouts, and branding—is owned by or licensed to TheMazicc or its licensors, suppliers, designers, and content partners.

Except where permitted by law or expressly authorized in writing, you may not:

• Copy, reproduce, republish, or distribute website content;
• Modify or create derivative works;
• Sell, resell, license, or commercially exploit content;
• Scrape, crawl, mirror, or systematically download content;
• Remove ownership or copyright notices; or
• Use TheMazicc branding in a misleading or unauthorized manner.

Copyright, Trademark, and DMCA-Style Complaints

If you believe content, artwork, photographs, designs, product listings, or other material available through TheMazicc infringes your copyright, trademark, design right, publicity right, or another proprietary right, email support@themazicc.com.

Include:

• Your name and contact information;
• Identification of the rights owner;
• A description of the protected work, mark, design, or other right;
• The exact page or material being reported;
• An explanation of the alleged infringement;
• A good-faith statement that the use is not authorized;
• A statement confirming the accuracy of the notice and your authority to act; and
• Your physical or electronic signature.

If United States copyright law applies, include any additional statements required for a valid notice under the Digital Millennium Copyright Act.

TheMazicc does not represent that it has appointed a registered DMCA agent unless expressly stated on a separate legal-notice page.

11. User Content and Feedback

If you submit reviews, comments, photographs, videos, artwork, personalisation, suggestions, proposals, feedback, or other material, you represent that you have the right to submit it.

You grant TheMazicc a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to use, reproduce, modify, publish, display, distribute, and otherwise use submitted material for operating, improving, supporting, and promoting the Services, subject to applicable privacy law.

You must not submit content that:

• Infringes intellectual-property, privacy, publicity, or other rights;
• Contains unlawful, defamatory, abusive, discriminatory, or threatening material;
• Contains malware or deceptive links;
• Misrepresents your identity;
• Contains false or misleading product claims; or
• Contains confidential information you are not authorized to disclose.

We may monitor, edit, reject, or remove submitted content where permitted by law.

12. Prohibited Uses

You may not use the Site or Services:

• For an unlawful, fraudulent, deceptive, abusive, or unauthorized purpose;
• To violate intellectual-property, privacy, consumer-protection, or other rights;
• To submit false payment, shipping, order, return, refund, or claim information;
• To obtain multiple refunds, replacements, credits, discounts, or insurance remedies for the same issue;
• To misuse chargebacks or payment disputes;
• To upload malware, viruses, destructive code, or harmful material;
• To interfere with website security, availability, or functionality;
• To access another person’s account without authorization;
• To collect personal information without lawful authority;
• To scrape or extract content through unauthorized automated means;
• To transmit spam, phishing, fraudulent, or deceptive communications;
• To harass, threaten, abuse, defame, or unlawfully discriminate against another person; or
• To circumvent geographic, payment, security, or order controls.

We may investigate suspected violations, suspend access, cancel affected orders, preserve relevant records, and cooperate with payment providers, carriers, regulators, or law-enforcement authorities where appropriate.

13. Third-Party Tools, Services, and Links

The Services may rely on Hostinger, payment processors, manufacturers, fulfilment facilities, shipping carriers, analytics providers, advertising platforms, marketing providers, communication providers, and other third parties.

We may provide access to optional third-party tools or services that we do not control.

Third-party services may be governed by their own:

• Privacy policies;
• Security practices;
• Fees;
• Availability; and
• Operating procedures.

Third-party links may direct you to websites or services not operated by TheMazicc.

We are not responsible for the independent content, availability, security, accuracy, policies, or practices of a third party, except to the extent responsibility cannot lawfully be excluded.

Personal information may be processed by service providers where necessary to:

• Produce and fulfil orders;
• Deliver parcels;

This does not remove rights arising from an accepted order or another protection that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, the Site and Services are provided on an “as is” and “as available” basis.

We do not warrant that:

• The Services will always be uninterrupted, secure, or error-free;
• Every website error will be corrected immediately;
• The Services will work with every device or browser;
• Third-party services will remain continuously available;
• Estimated delivery dates will always be met; or
• Website information will be free from every technical or display error.

This disclaimer does not apply to an express remedy stated in a TheMazicc policy or a consumer right, statutory guarantee, legal warranty, or remedy that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, TheMazicc and its officers, employees, contractors, suppliers, licensors, manufacturers, fulfilment partners, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from use of or inability to use the Services.

Such losses may include loss of profits, revenue, savings, data, business opportunity, reputation, or anticipated benefit.

To the fullest extent permitted by law, our total liability arising from a particular order will not exceed the amount paid to TheMazicc for the product or order giving rise to the claim.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify TheMazicc and its officers, employees, contractors, licensors, suppliers, and service providers against third-party claims, losses, liabilities, damages, and reasonable costs arising from:

• Your unlawful use of the Services;
• Your material violation of these Terms;
• Your infringement of another person’s rights;
• Content submitted by you; or
• Fraudulent or unauthorized activity conducted through your account.

This obligation does not apply to the extent a claim was caused by our breach, negligence, unlawful conduct, or another responsibility that cannot legally be transferred to the customer.

19. Applicable Law and Disputes

These Terms and any dispute arising from the Services or a purchase from TheMazicc are governed by the laws that apply to the relevant transaction and the parties.

Because TheMazicc has not identified a specific governing-law state or exclusive legal forum, these Terms do not require consumers to bring claims exclusively in a particular state or country.

Nothing in these Terms deprives a consumer of mandatory protections or access to a court, tribunal, regulator, or dispute-resolution process available under applicable law.

Before commencing formal proceedings, the parties are encouraged to contact one another and make a good-faith effort to resolve the dispute informally.

20. General Provisions

Termination

We may suspend or terminate access where we reasonably believe a user has violated these Terms, engaged in unlawful activity, threatened website security, or abused payment, refund, replacement, insurance, or promotional procedures.

Termination does not remove obligations or liabilities that arose before termination.

Changes to These Terms

We may update these Terms to reflect operational, legal, regulatory, security, technological, or business changes.

The current version will be posted on this page with a revised “Last updated” date.

Where required by law, we will provide additional notice or obtain consent.

Severability

If a provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted or separated from the remaining Terms. The other provisions will remain effective.

No Waiver

A failure or delay in enforcing a provision does not waive the right to enforce it later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms as part of a merger, acquisition, financing, restructuring, sale of assets, or transfer of the business, subject to applicable law.

Entire Agreement

These Terms, the policies incorporated by reference, and order-specific terms displayed at checkout constitute the agreement between the customer and TheMazicc concerning the Services.
